- Seniority supplement (12 monthly payments): In a meeting held on 25 February 1998, the Plenary Session of the General Council of the Judiciary made the following decision: "To approve the payment of a seniority supplement to the Members whose gross annual salary accruals after three-year periods of service come to less than the amount corresponding to five salary increments for three-year periods of service in the Judicial Career. Said seniority supplement shall be the minimum amount required at any given time to complete the difference". The monthly amount to be paid for the aforementioned seniority supplement shall correspond to five salary increments for three-year periods of service in the Judicial Career. In the 2023 financial year, it came to 507,44 euros per month.
The members of the General Council of the Judiciary who fulfil their position on a non-exclusive basis shall only receive the travel expenses for attending the Plenary Session or the Committees, stipulated at 975 euros and 312 euros, respectively, with no entitlement to further remuneration for the position of Member, with the exception of any compensations for services that may be due to them. Members of the judicial career assigned to the Economic Affairs, Equality and Disciplinary Commissions will continue to receive the ordinary remuneration corresponding to the position they hold in the exercise of their jurisdictional functions at the expense of the Ministry of Justice in accordance with Law 15/2003, of 26th May 2003, regulating the remuneration system of the Judicial and Prosecutorial Careers.

Information on the compensation for abandonment of the position of President
In the General Council of the Judiciary there is only one compensation for abandonment of position: compensation for the President of the Supreme Court and of the General Council of the Judiciary.

Pursuant to Article 10.5 of Law 74/1980, the President of the General Council of the Judiciary would be entitled to receive a monthly compensatory pension equal to one twelfth of 80 percent of the total amount of remunerations allocated to the respective position in the Budget that was current during the aforementioned period. The compensatory pension would come into effect on the month immediately following the month on which the President's dismissal occurred, and for a period equal to the length of time in service.

The compensation stipulated in Royal Decree 20/2012, of 13 July, on measures to ensure budget stability and promote competitiveness, in Article 1 on the regime of incompatibilities of compensatory pensions, compensatory benefits and similar payments.

At its meeting of 19rd January 2023, the Permanent Committee approved the Rules on Reimbursement for Travel Expenses and Expenses of a Formal or Representative Nature charged to the budget of the General Council of the Judiciary, and which have their origin in the regulations of the Update of the Control of Management and Transparency Regime of the General Council of the Judiciary passed by agreement at the Plenary Session of 28 June 2012.
In the Permanent Committee it was agreed to delegate to the Economic Affairs Committee the competencies in matters of authorisation of secondments or trips within national territory, except for attending Plenary Sessions, legal committees, formally constituted working groups, forums and observatories where the Council is represented, official acts organised by the Council or with official presence of the Council and the assumption of office of Supreme Court magistrates and presidents of higher courts of justice, in accordance with the stipulations of Article 13(1) of Law 30/1992, of 26 November, on Legal Arrangements of the Public Administrations and of the Common Administrative Procedure.
The regulations approved by the Permanent Committee govern the system of expenditure control, for Senior Officials, in the following terms:
1.1 Arrangements for official trips
1.1.1 Authorisations
For the undertaking of official trips, the President, Members, whatever Committee they belong to, and General Secretary (Senior Officials), will be subject to the following authorisation regime:
a) Attending Plenary Sessions, the Disciplinary Committee, the Economic Affairs Committee, the Equality Committee and the Permanent Committee for purposes of Classification.
The authorisation of the secondment or trip is understood to be granted with the convening of the corresponding meetings.
b) Formally constituted working groups, forums and observatories where the Council is represented, official acts organised by the Council or with official presence of the Council.
The authorisation of the secondment or trip is understood to be granted with the convening of the corresponding meetings.
c) Attending the assumption of office of Supreme Court magistrates and Presidents of Higher Courts of Justice.
The authorisation of the secondment or trip is understood to be granted with the announcement of the assumption of office.
d) Other activities within national territory.
The authorisation of the secondment or trip must be granted by the Economic Affairs Committee, except where for reasons of urgency the authorisation is not possible in time. In this case it will be authorised by the President of the Economic Affairs Committee.
In the event of trips by the President of the Economic Affairs Committee, authorisations for reasons of urgency will be the responsibility of the President of the Council.
Requests for authorisation for senior officials’ secondment or travel within Spain should be made in advance through the Finance Committee by sending an e-mail to cae@cgpj.es.
The President of the Economic Affairs Committee, or where appropriate the President of the Council, will inform said Committee of the authorisations issued as a matter of urgency.
e) Activities outside national territory.
The Permanent Committee will approve, for economic purposes, the authorisation of the secondment or trip where these involve journeys outside national territory.
1.1.2 Communications
Travel to attend formally constituted working groups, forums and observatories in which the Council is represented, official events organised by the Council or with the official presence of the Council (1.1.1.b) and the inauguration of Supreme Court Justices and Presidents of High Courts of Justice (1.1.1.c) shall be notified through the Finance Committee, by sending an e-mail to cae@cgpj.es, before departure, for the sole purpose of including the information on the Finance Committee’s agenda and publishing it on the Transparency Portal (form 8).
1.1.3 Transparency of the authorisations and communications
The Senior Officials of the Council must include, in their applications for authorisation and in their communications, the place, date and purpose of their official trips.
The authorisations and communications will appear in the Council's transparency portal, via the publication of the agenda and the minutes of the Economic Affairs Committee and the Permanent Committee, and also via the quarterly publication of the list of trips made by Senior Officials of the Council.
The authorisations and communications will be necessary for processing the settlement for the trip.
1.2 Justification of travel expenditure
When Council Senior Officials undertake, within national territory, any of the functions that, in accordance with Royal Decree 462/2002 of 24 May on compensation for reasons of services rendered, are subject to compensation, they will be reimbursed in accordance with the general expenses regime, with the limitations and restrictions indicated below.

To complete the corresponding form, when involving trips within national territory, the authorisation or communication of the trip (section 1.1.3 of the regulations). the specific activity of the official trip related to the position and functions will be recorded in the settlement of expenditure, together with the destination, itinerary, and dates and times of outgoing and return trips.
Travel days, save legitimate cause, will comprise those where the activity was undertaken plus the previous and subsequent day, where necessary, for the effects of travel or where the activity requires this.
To the same extent, where it involves a foreign trip, prior authorisation for the secondment or the journey from the Permanent Committee will be required, which will state the conditions of the trip and corresponding budget, and the destination, itinerary, and dates and times of outgoing and return trips must equally be reflected in the settlement of expenditure, corresponding with those authorised by the Permanent Committee, save for justified emergency or unforeseen circumstances, which must be evaluated by the Committee.
1.3 Family residence
Family residence in a municipal district distinct from the destination: To guarantee the equality of all Members independently of their residence and given the temporary nature of the position, in application of Royal Decree 462/2000, of 24 May, Senior Officials must have the right to reimbursement for travel expenses generated as a consequence of maintaining the family residence in a municipality distinct from the destination. These trips will be limited to one outgoing and one return trip per week and public holidays and holiday periods, save a duly justified exceptional circumstance. In the corresponding settlement of expenditure the motive for these trips will be recorded as travel to Family Residence.
1.4 Travel class
Air travel for the Council’s senior officers shall be at the most economical fare suitable for the activity in question. Air travel may only be used for journeys of more than three hours’ duration. When no tickets are available in that category, the travel provider shall justify when settling payment for the travel.
High-speed train (AVE) journeys will be made at the Tourist fare. However, a class higher than Tourist may be used when there are no tickets available in Tourist. In such cases, the travel provider shall submit evidence when settling the travel expenses. Activities shall be planned sufficiently in advance, always using the most economical fares.
1.5 Trips attended by Council personnel
The need for Senior Officials to make trips charged to the Council budget, assisted by personnel at the service of the Council, must be expressly justified in the documentation of the administrative file with explicit reference to the specific activities to be undertaken by said personnel. In such cases, Senior Officials must travel assisted by necessary Council personnel and only where it is strictly necessary for the personnel to travel in order to undertake the specific activity that is the reason for the journey.
1.6 Ceremonial or representative expenditure relating to Senior Officials
Expenditure produced as a consequence of the ceremonial and representative acts that Senior Council Officials are required to undertake when performing their functions, both in national and foreign territory, where this expenditure is of benefit or use to the Judicial Administration and where specific credits do not exist under other items.
Senior Council Officials must describe the object of the expenditure that is justified and a reference to the position or profession of the individual or individuals that produce it (member or senior official from government, parliament, legal authority, local authority, constitutional body or similar). This has the purpose of determining that the expenditure was effectively carried out for ceremonial or representative purposes and that it is adjusted to the activities of this Body.
When ceremonial or representative expenditure takes place during one of the trips referred to in the previous section, it will be settled together with expenditure related to travel, accommodation and maintenance that, where relevant, has been incurred.
1.7 Advance payments
Whenever Senior Officials of the Council make official trips on the Council's behalf, or have to spend money for "reasons of protocol or representation" they may request an advance payment from the Council Management for the approximate amount of accommodation, sustenance and travel expenses to which they may be entitled, by meeting the following requirements:
- Present model II (Advance Payment Official Trip) in writing, at least 24 hours in advance of its availability, if the trip is within national territory or, if the trip is abroad, if the currency requested is the euro.
- Present model III if the trip is abroad and the advance payment is requested in another currency. If the currency requested is the dollar, the request for advance payment must be presented at least 24 hours in advance of its availability. In the event that a currency other than the dollar is requested, the request must be made at least 48 hours in advance, also using model III.
- Settlement of expenses incurred, once the trip is completed or the ceremonial or representative expenditure effected, for whichever the advance payment was requested, within a maximum period of ten business days to be counted from completion of the trip.
The amount paid in advance will be deducted from the total sum to be paid to the interested party, which results from the settlement of expenditure.
If it is necessary to pay back money from the advance payment, this may be done in cash, in a cheque payable to the Council, or by a bank transfer to the Council's account. No further advance payments may be requested until, where applicable, the balance resulting from the settlement of expenditure is repaid.
1.8 Settlement of expenditure
In the case of official travel with entitlement to allowances, the corresponding expenses claim must be submitted within the first ten days of the month following the month in which the expenditure was incurred together with the monthly summary of claims (Form 4.3 and, if applicable, Form 4.4).
One form shall be completed for each trip (Form 1.1). It must detail the travel, accommodation and subsistence expenses incurred. It must be submitted together with all the supporting documents for the expenses scanned (invoices, tickets, boarding passes, tickets, and other documentation) as a single PDF and signed electronically. The travel provider’s invoices must also be attached to this PDF file. Both form 4.3 and all the signed PDF files for each expense claim must be sent to Gerencia.dietas.vocalias@cgpj.es.
If expenses for representation entertaining have been incurred during travel, forms 1.1 and 4.1 are settled together.
When only expenses for protocol or representative entertaining are settled, form 4.1 must be filled in. It must be made into a single PDF file together with the scanned invoices. The file must be signed electronically and sent to Administration at the e-mail address Gerencia.dietas.vocalias@cgpj.es.
The scanned invoices for the expense must comply with the requirements established by current regulations.
All original invoices, tickets, boarding passes, tickets and other documentation justifying the expense must be retained for four years and made available to the Council if necessary for verification.
When changes to planned activities as a result of unforeseen circumstances have given rise to expenses for fees for ticketing changes or cancellations, these must also be shown on the expenses claim form (Form 1.1, Observations section), and must always be submitted, even if there are no personal expenses.
1.8.1 Transport
When a trip is made on the Council's behalf, model I must be completed, where the day and the time of departure and arrival, itinerary, destination and reason for the trip must all be recorded.
For expenses for using carriers’ VIP lounge services or other transport costs (such as government fleet car service, car hire company with driver), a scanned copy of the invoice must be submitted. If any invoice for VIP lounges or fleet car use is missing from the travel expenses claim, this shall be stated on the monthly summary sheet, clearly stating which supporting document is not provided because it is unavailable.
Scanned tickets or boarding passes, and the invoice must be submitted, even if the person concerned has not paid for it because the Council’s travel provider has arranged the travel.
In the event of loss or misplacement of a ticket or boarding card, the Senior Official must sign a statement of responsibility where this circumstance is recorded.
Taxi and parking expenses will also be paid, and other expenses referred to in Royal Decree 462/2002 strictly related to the official trip and always justified with original invoices or receipts.
The receipts, electronic tickets and other documents proving expenditure must meet the requirements outlined in the current legislation.
1.8.2 Expenses for accommodation, maintenance and other expenses
Accommodation
Payment will be made of the total amount of the accommodation and other expenses referred to by Royal Decree 462/2000 strictly related to the official trip and always justified with original invoices or receipts in the name of the interested party, up to the daily maximum limit, in national territory, for the amount established in section 1.2 of these regulations. Where the journey is outside national territory the amount agreed by the Permanent Committee will be paid on authorisation of the trip. In any event, accommodation will be limited to the days during which the activity is undertaken, plus the previous and subsequent days should these be necessary for the effects of the journey or the undertaking of the activity.
In exceptional cases, when the accommodation expense is greater and subject to request and justification by the senior officer concerned, the General Secretary may authorise a greater amount than that approved.
Maintenance
Payment will be made of maintenance expenses, in accordance with that set out for group 1 by Royal Decree 462/2000, currently set at 53.34 Euros per complete day (Annex II of Royal Decree 462/2002), settled in accordance with the criteria outlined in article 12 of the aforementioned Royal Decree.
In the case of entertaining others in an official capacity (lunch or dinner), this must be stated on form 1.1 in the Remarks section and on the monthly summary.

1.- El presidente del Tribunal Supremo y del Consejo General del Poder Judicial, y el presidente de Transparencia Internacional España suscribieron el 11 de julio de 2022 la prórroga por cuatro años del convenio de colaboración entre ambas instituciones firmado el 11 de julio de 2018, que amplía el suscrito en 2014 y que tiene como objetivo profundizar en la política iniciada ya entonces por el órgano de gobierno de los jueces de funcionamiento transparente acorde a los estándares nacionales e internacionales.
2.- El convenio firmado el 2 de julio de 2014 supuso que, además de mantener e implementar de manera estricta y rigurosa las obligaciones que sobre publicidad activa prevé la Ley 19/2013, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno, el Consejo General del Poder Judicial hiciera pública de forma clara, comprensible y reutilizable toda una serie de información adicional.
3.- En el marco del convenio de 2018 se da un paso más en esa línea, al poner de manifiesto el Consejo General del Poder Judicial que, además de dar estricto cumplimiento a la Ley 19/2013, de 9 de diciembre, este Órgano Constitucional está interesado en consolidar una verdadera política de transparencia en su funcionamiento, que constituya un eje fundamental de su actividad, convirtiéndose de esta forma en un modelo de gestión transparente en el contexto de las Administraciones y Órganos Constitucionales del Estado.
4.- Por ello, con la firma de dicho convenio, el Consejo General del Poder Judicial se comprometió a profundizar en la política ya iniciada de funcionamiento transparente acorde a los estándares nacionales e internacionales y, en concreto, se comprometió a mantener e implementar de manera estricta y rigurosa las obligaciones que sobre publicidad activa previene la Ley 19/2013, así como a elaborar y dar publicidad de forma clara, comprensible y reutilizable, cuando su naturaleza lo permita, a toda una serie de información adicional recogida en los dos Anexos del Convenio.
5.- El Anexo I recoge los indicadores que ya quedaron incorporados al Convenio firmado el 2 de julio de 2014, y que Transparencia Internacional ya ha constatado formalmente que han sido cumplidos en su integridad.
6.- El Anexo II recoge una relación adicional de indicadores que, sumados a los anteriores, habrán de ser igualmente objeto de cumplimiento por el Consejo General del Poder Judicial.
7.- Con la firma el 11 de julio de 2022 de la prórroga por cuatro años del Convenio de 2018, se sustituye el Anexo II por el Anexo B, con un nuevo listado de indicadores, uno de los cuales es «Elaboración para su publicación en el Portal de Transparencia del CGPJ de una guía informativa de los escenarios de posibles conflictos de intereses y la solución ofrecida legalmente».
8.- La Ley 19/2013, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno de España, reconoce a los conflictos de intereses como situaciones que pueden afectar la objetividad e imparcialidad de las personas servidoras públicas de modo que, cuando intervienen, con motivo de sus funciones en la atención, tramitación o resolución de un asunto bajo este supuesto, son sujetos de responsabilidad administrativa. Por ello, dicha Ley establece un régimen sancionador en tres áreas, una de las cuales es en materia de conflicto de intereses.
9.- En lo que respecta a este ámbito, esta Ley se aplica a los altos cargos del Estado, contratistas y demás sujetos obligados. Estos deben declarar sus bienes y rentas, impuesto sobre la renta y complementarios, y registrar sus conflictos de interés. Por ello, el artículo 27 de la Ley 19/2013 establece que «el incumplimiento de las normas de incompatibilidades o de las que regulan las declaraciones que han de realizar las personas comprendidas en el ámbito de este título será sancionado de conformidad con lo dispuesto en la normativa en materia de conflictos de intereses de la Administración General del Estado»; no obstante, a renglón seguido, el propio precepto determina, en relación a la sanción por incumplimiento del régimen de incompatibilidades, que la misma se exigirá «para el resto de Administraciones de acuerdo con su propia normativa que resulte de aplicación».
10.- El artículo 122.2 CE establece como una de las materias reservadas a la Ley Orgánica reguladora del Consejo General del Poder Judicial «el régimen de incompatibilidades de sus miembros».
11.- En la regulación de ese régimen efectuada por la Ley Orgánica 4/2013, de 28 de junio, de reforma del Consejo General del Poder Judicial, por la que se modifica la Ley Orgánica 6/1985, de 1 de julio, del Poder Judicial, cabe distinguir las causas de incompatibilidad originarias, que impedirían la designación como Vocal, y las causas de incompatibilidad sobrevenidas que determinan el cese de apreciarse su concurrencia.
12.- En cuanto a las primeras, baste decir que el artículo 567.3 LOPJ en relación con los Vocales de origen no judicial dispone que «[q]uien, deseando presentar su candidatura para ser designado Vocal, ocupare cargo incompatible con aquél según la legislación vigente, se comprometerá a formalizar su renuncia al mencionado cargo si resultare elegido». Por su parte, en relación con los Vocales de origen judicial, el artículo 573 LOPJ dispone lo siguiente: «1. Cualquier Juez o Magistrado en servicio activo en la carrera judicial podrá presentar su candidatura para ser elegido Vocal por el turno judicial, salvo que se halle en alguna de las situaciones que, conforme a lo establecido en esta Ley, se lo impidan. 2. El Juez o Magistrado que, deseando presentar su candidatura para ser designado Vocal, ocupare cargo incompatible se comprometerá a formalizar su renuncia al mencionado cargo si resultare elegido».
13.- El régimen de incompatibilidades sobrevenidas viene establecido por los artículos 579, apartados 1, 2 y 3; 580, apartado 1; y 582, apartado 1, todos ellos de la LOPJ. Los referidos preceptos disponen lo siguiente:
«Artículo 579.
- Los Vocales del Consejo General del Poder Judicial, salvo los que integren la Comisión Permanente, permanecerán en servicio activo si pertenecen a la carrera judicial o a algún cuerpo de funcionarios, y seguirán desempeñando su actividad profesional si son abogados, procuradores de los Tribunales o ejercen cualquier otra profesión liberal.
- Los Vocales que integren la Comisión Permanente, durante el tiempo que formen parte de la misma, desempeñarán su cargo con carácter exclusivo y pasarán, en su caso, a la situación administrativa de servicios especiales en su cuerpo de origen.
- No podrá compatibilizarse el cargo de Vocal con dedicación exclusiva con el desempeño simultáneo de otras responsabilidades gubernativas en el ámbito judicial. En caso de concurrencia y mientras se ostente el cargo de Vocal con dedicación exclusiva, estas responsabilidades serán asumidas por quien deba sustituir al interesado según la legislación vigente.
[…]
Artículo 580.
- El ejercicio de la función de Vocal del Consejo General del Poder Judicial será incompatible con cualquier otro cargo público, electivo o no electivo, con la sola excepción en su caso del servicio en el cuerpo a que pertenezcan.
[…]
Artículo 582.
- Los Vocales sólo cesarán en sus cargos por el transcurso de los cinco años para los que fueron nombrados, así como por renuncia aceptada por el Presidente del Tribunal Supremo y del Consejo General del Poder Judicial, o por incapacidad, incompatibilidad o incumplimiento grave de los deberes del cargo, apreciadas por el Pleno del Consejo General del Poder Judicial mediante mayoría de tres quintos.

14.- Hasta tanto no entre en vigor el nuevo régimen de dedicación de los Vocales previsto en la LO 4/2018, de 28 de diciembre, de reforma de la Ley Orgánica 6/1985, de 1 de julio, del Poder Judicial (Disposición transitoria tercera), el legislador orgánico ha optado por establecer un régimen de incompatibilidades distinto para los Vocales que integren la Comisión Permanente y los Vocales que no forman parte de esta comisión legal. Los primeros tienen un régimen de dedicación exclusiva que comporta que aquellos que tengan la condición de funcionarios públicos pasen a la situación de servicios especiales en sus cuerpos de origen. Se precisa, además, que los Vocales de origen judicial con dedicación exclusiva no podrán compatibilizar su cargo con el desempeño simultáneo de otras responsabilidades gubernativas en el ámbito judicial. Asimismo, el cargo de Vocal con dedicación exclusiva es incompatible con el ejercicio de cualquier actividad profesional (art. 579.1 LOPJ a contrario).
15.- Los Vocales sin dedicación exclusiva, esto es, aquellos que no formen parte de la Comisión Permanente, pueden compatibilizar la función de Vocal con el servicio activo en la carrera judicial u otro cuerpo funcionarial al que pertenezcan o con el ejercicio de la profesión de abogado o procurador u otra profesión liberal.
16.- De acuerdo con el artículo 580.1 LOPJ, se dispone la incompatibilidad «con cualquier otro cargo público, electivo o no electivo, con la sola excepción en su caso del servicio en el cuerpo a que pertenezcan».
17.- Asimismo, en relación con los conflictos de intereses, hay que tener en cuenta lo siguiente: a) el apartado 2 del artículo 580 LOPJ se refiere a que regirán para los Vocales del Consejo General del Poder Judicial las causas de abstención y recusación legalmente establecidas para las autoridades y personal al servicio de la Administración General del Estado y, en todo caso, deberán abstenerse de conocer aquellos asuntos en los que pueda existir un interés directo o indirecto, o cuando su intervención en los mismos pudiera afectar a la imparcialidad objetiva en su actuación como Vocal; b) el apartado 3 del mencionado precepto establece que los Vocales del Consejo General del Poder Judicial no podrán invocar o hacer uso de su condición de tales en el ejercicio de su profesión; y, c) el apartado 4 del artículo mencionado considera un incumplimiento muy grave de los deberes inherentes al cargo de Vocal el quebrantamiento de la prohibición impuesta en el apartado anterior, así como la utilización de su condición de tal para cualesquiera fines, públicos o privados, ajenos al adecuado ejercicio de las atribuciones del Consejo General del Poder Judicial.
18.- En cuanto a las consecuencias del incumplimiento muy grave contemplado en el apartado 4 del artículo 580, establece el mismo apartado 4 que el Pleno por mayoría de tres quintos podrá destituir al Vocal infractor.
19.- Del mismo modo el apartado 1 del artículo 582 LOPJ establece que el Pleno, con la misma mayoría, podrá apreciar la incompatibilidad o incumplimiento grave de los deberes del cargo, lo que determinará el cese del Vocal afectado.
20.- LO 4/2018, de 28 de diciembre, de reforma de la Ley Orgánica 6/1985, de 1 de julio, del Poder Judicial, modifica la redacción del artículo 579 LOPJ y suprime el apartado 1 del artículo 580. Estas modificaciones no entrarán en vigor hasta la constitución del primer Consejo General del Poder Judicial que lo haga tras la entrada en vigor de esta Ley (Disposición transitoria tercera), por lo que actualmente no están en vigor, ya que no se ha constituido nuevo consejo desde la entrada en vigor de dicha Ley.
21.- Cuando ello suceda, la redacción del artículo 579, en sus apartados 1, 3 y 5, será la siguiente:
«Artículo 579.
- Los Vocales del Consejo General del Poder Judicial desarrollarán su actividad con dedicación exclusiva, siendo su cargo incompatible con cualquier otro puesto, profesión o actividad, públicos o privados, por cuenta propia o ajena, retribuidos o no, a excepción de la mera administración del patrimonio personal o familiar. Les serán de aplicación, además, las incompatibilidades específicas de los jueces y magistrados enunciadas expresamente en el artículo 389.
[…]
- No podrá compatibilizarse el cargo de Vocal con el desempeño simultáneo de otras responsabilidades gubernativas en el ámbito judicial. En caso de concurrencia y mientras se ostente el cargo de Vocal, estas responsabilidades serán asumidas por quien deba sustituir al interesado según la legislación vigente.
[…]
- El Presidente, los Vocales y el Secretario General del Consejo General del Poder Judicial están sujetos al deber de efectuar una declaración de bienes y derechos y al control y gestión de activos financieros de los que sean titulares en los términos previstos en los artículos 17 y 18 de la Ley 3/2015, de 30 de marzo, reguladora del ejercicio del alto cargo de la Administración General del Estado, con las adaptaciones que sean precisas a la organización del Consejo, que se establecerán en el Reglamento de Organización y Funcionamiento del mismo […]».
Y desaparece el apartado 1 del artículo 580 LOPJ.
22.- Lo anterior supondrá la equiparación del régimen de incompatibilidades para los Vocales que integren la Comisión Permanente y los Vocales que no forman parte de esta comisión legal, pues ya no existirá distinción, siéndoles de aplicación a todos ellos las incompatibilidades específicas de los jueces y magistrados recogidas en el artículo 389 LOPJ. En este precepto se listan de manera detallada todas las causas de incompatibilidad de los Jueces y Magistrados, que serán aplicables también a todos los miembros del CGPJ, del siguiente modo:
«Artículo 389.
El cargo de Juez o Magistrado es incompatible:
1º) Con el ejercicio de cualquier otra jurisdicción ajena a la del Poder Judicial.
2º) Con cualquier cargo de elección popular o designación política del Estado, Comunidades Autónomas, Provincias y demás entidades locales y organismos dependientes de cualquiera de ellos.
3º) Con los empleos o cargos dotados o retribuidos por la Administración del Estado, las Cortes Generales, la Casa Real, Comunidades Autónomas, Provincias, Municipios y cualesquiera entidades, organismos o empresas dependientes de unos u otras.
4º) Con los empleos de todas clases en los Tribunales y Juzgados de cualquier orden jurisdiccional.
5º) Con todo empleo, cargo o profesión retribuida, salvo la docencia o investigación jurídica, así como la producción y creación literaria, artística, científica y técnica y las publicaciones derivadas de aquélla, de conformidad con lo dispuesto en la legislación sobre incompatibilidades del personal al servicio de las Administraciones Públicas.
6º) Con el ejercicio de la Abogacía y de la Procuraduría.
7º) Con todo tipo de asesoramiento jurídico, sea o no retribuido.
8º) Con el ejercicio de toda actividad mercantil, por sí o por otro.
9º) Con las funciones de Director, Gerente, Administrador, Consejero, socio colectivo o cualquier otra que implique intervención directa, administrativa o económica en sociedades o empresas mercantiles, públicas o privadas, de cualquier género».
23.- Todos tendrán un régimen de dedicación exclusiva que comporta que aquellos que tengan la condición de funcionarios públicos, tanto judiciales como no judiciales, pasen a la situación de servicios especiales en sus cuerpos de origen (apartado 2 del artículo 579). Se precisa, además, que ninguno de ellos podrá compatibilizar su cargo con el desempeño simultáneo de cualquier otro puesto, profesión o actividad, públicos o privados, por cuenta propia o ajena, retribuidos o no, a excepción de la mera administración del patrimonio personal o familiar. Asimismo, no podrán compatibilizar su cargo con el desempeño simultáneo de otras responsabilidades gubernativas en el ámbito judicial, debiendo ser asumidas dichas responsabilidades por quien deba sustituir al interesado según la legislación vigente (se entiende para el caso de los Vocales de origen judicial).
24.- Además, tanto el Presidente, como los Vocales (y el Secretario General), están sujetos al deber de efectuar una declaración de bienes y derechos y al control y gestión de activos financieros de los que sean titulares en los términos previstos en los artículos 17 y 18 de la Ley 3/2015, de 30 de marzo, reguladora del ejercicio del alto cargo de la Administración General del Estado, con las adaptaciones que sean precisas a la organización del Consejo, que se establecerán en el Reglamento de Organización y Funcionamiento del mismo, lo que hasta ahora no se recogía expresamente y con lo que se da cumplimiento en parte al punto 14 del Anexo B del Convenio, añadido en la prórroga de 11 de julio de 2022, cuya redacción es la siguiente: «Ficha individualizada de cada uno de los altos cargos del CGPJ, incluyendo fotografía, breve curriculum, correo electrónico y teléfono de contacto, identificación de su Secretaria y ubicación de su despacho en el CGPJ. Retribución. Indemnizaciones que podrían recibir tras el cese de sus cargos. Si se tratara de altos cargos, que vayan a gestionar intereses económicos de la Institución, relación sucinta del valor económico de su patrimonio actual. Personal eventual asignado directamente al alto cargo».
25.- En todo caso y en lo relativo al deber de efectuar una declaración de bienes y derechos y al control y gestión de activos financieros de los que sean titulares, la LO 4/2018, de 28 de diciembre, prevé una modificación de Acuerdo de 22 de abril de 1986, del Consejo General del Poder Judicial, por el que se aprueba el Reglamento de Organización y Funcionamiento del Consejo General del Poder Judicial, con el fin de efectuar las adaptaciones que sean precisas a la organización del Consejo, en lo que sea necesario con el fin de ajustar la regulación de Ley 3/2015, de 30 de marzo al la situación específica del Presidente y de los Vocales del CGPJ, diferente del resto de los cargos de la AGE.
26.- El régimen de abstención y recusación no se modifica, ni tampoco el procedimiento ni el órgano encargado de apreciar las causas de incompatibilidad o de abstención y recusación.
